Personal Restraint Petition of Darcy Dean Racus. Petitioner argues that (1) the trial court erred when it refused to instruct the jury on the entrapment defense, (2) this issue is not time barred under RCW 10.73.090 because State v. Arbogast, 199 Wn.2d 356 (2022), is a significant change in the law, (3) the State failed to disclose exculpatory evidence, (4) the State deprived him of his right to due process and a fair trial when it failed to disclose before trial that it would be introducing expert testimony from a law enforcement witness, and (5) defense counsel failed to provide effective assistance of counsel on several grounds.
